[38 N.Y.2d 960 Page 960] APPEAL from an order of the Appellate Division of the Supreme Court in the Fourth Judicial Department, entered March 6, 1975, which (1) reversed, on the law, a judgment of the Supreme Court (JAMES H. BOOMER, J.), entered in Monroe County in a proceeding pursuant to CPLR article 78, which, following a jury trial of the issue of whether petitioner had been told the reason for the termination of his services as a probationary teacher at a State school for boys, and a verdict that he had not been told the reason, directed his reinstatement and awarded him damages for lost wages, and (2) dismissed the petition. The Rules and Regulations of the Department of Civil Service (4 NYCRR 4.5) provided that A probationer whose services are to be terminated for unsatisfactory service shall receive written notice at least one week prior to such termination and, upon request, shall be granted an interview with the appointing authority or his representative.
